About this Webinar

Trustees hold assets for the benefit of the beneficiaries.  However, it is common for a Settlor to hold powers of revocation and investment over the Trust assets, such powers may present false understanding of ownership of the Trust assets to the Settlor.  During challenging financial conditions Trustees are required to exercise their fiduciary duty to the beneficiaries whilst acknowledging the Settlor’s investment power over the Trust assets where a request for distributions to cover margin calls, cross pledges and guarantees are requested by the Settlor. 

What are the issues a Trustee should consider? Can a Trustee limit their risk? What do Trustees have in place for such situations?

Some issues to be addressed in this webinar include:

  • What can potentially go wrong for the trustee?

Mr. Marcus Hinkley - Head of Private Client Services Asia, Hawksford

Marcus leads the Private Client business in Asia for Hawksford. Prior to joining Hawksford, Marcus had a successful 20-year career as a private client lawyer. Marcus has previously been recognised by Legal 500 for his international trust experience and formerly as one of the top 10 private client lawyers in Singapore by Who’s Who Legal.  

Marcus has substantial experience advising entrepreneurs and wealthy families in the Asian region on their business and estate planning needs and this includes advising on business and family succession, trusts, family governance, private trust companies, charities and foundations. 

Marcus holds an Honours degree in Law, a Bachelors of Arts and a Masters of Taxation degree, and is a member of the Society of Trust & Estate Practitioners (STEP).

Derek has over the last 10 years worked with high net worth individuals and families on their succession and wealth structuring plans.

His main area of focus is setting up structures to hold the financial and other private assets of clients with the view of meeting their wealth transference objectives in the form of trusts, corporate structures, funds or a combination of these. Having dealt with a diverse range of clients, he has had the opportunity to work with many unique family situations and as a result, conceptualised solutions to varying needs.

He holds a Bachelor of Commerce (Hons) degree, Bachelor of Laws and a Master of Laws from the University of Melbourne.
