A boom in the trust business may potentially lead to a boom in trust litigation driven by :

  • Diversity of beneficiaries – I.e. not father and son but cousins and second cousins
  • Poorly advised structures not fit for purpose
  • Greater global wealth
  • More 'defensive' trustees v more litigious beneficiaries
  • Overlooked conflicts of interest
  • Increasing complexity of global fiscal regimes

Family woes arising from divorces and post Brexit, would UK remain the divorce capital of the world :

  • Needs based regime rather than formulaic and therefore potentially more beneficial to 'poorer' spouse
  • Where are we on pre-nup and post nups?
  • No fault regime, no community of property regime
  • Jurisdictional issues in establishing England and Wales as principal jurisdiction

About the Chairperson:

Ms Chee Fang Theng – Director, Pan Asia Law LLC

Fang Theng is a director of Pan Asia Law LLC with 20 years of experience in tax, estates and trusts, acting for many wealthy families, trust companies, and multinational corporations.  She also represents clients before the Singapore courts, focusing on tax, probate and trust issues. Fang Theng is qualified as an advocate and solicitor in Singapore, as well as a solicitor in England.  She is a member of the technical steering committee of the Singapore Trustees Association and committee member of the Society of Trusts and Estates Practitioners (Singapore branch), and a Fellow of the Singapore Institute of Arbitrators. She has participated in various committees set up to examine proposed tax and trust legislation, and is included in the list of recommended tax practitioners in Legal 500, Chambers, PLC Cross-border Tax, PLC Private Client, which are jurisdictional guides to leading tax and private client lawyers worldwide.

Nick is a partner in the Private Client group and Head of the International Private Wealth group. Nick's practice is truly international in nature, representing individuals, families and family offices in the Middle East, the USA and Europe as well as the UK.
